eCommerce - Terms and Conditions

  1. “AEM” and “AEM International, Ltd.” refer to the same entity and are interchangeable for these Terms and Conditions.
  2. Overview: Buyer’s acceptance of goods and/or services shall constitute acceptance of these terms and conditions. Terms or provisions of the Buyer’s order that are inconsistent with or in addition to AEM’s terms and conditions shall not be binding unless accepted in writing by AEM. AEM’s failure to object to any provision contained in a communication from Buyer shall not be a waiver of these terms and conditions.  If any terms or conditions of sale are declared by an arbitrator, or court or other body having jurisdiction, to be invalid or unenforceable, the remaining terms and provisions shall remain in full force and effect.  This transaction shall be governed by the laws of the state of Arizona, U.S.A.
  3. Eligibility: Products available to purchase directly from AEM-Test.com are only available for sale and shipment to customers in the United States of America.
  4. Warranty: The TestPro and NSA (Network Service Assistant) test platforms carry a 2-year standard warranty for manufacturing defects and workmanship. Upon product registration within 90 days of purchase, AEM will extend this warranty period by an additional 3 years to provide a 5-year warranty on the test platforms. All Test Adapters and accessories carry a 1-year warranty for manufacturing defects and workmanship. The warranty period starts on the date of purchase and does not include coverage for normal wear, abuse or damage. For product registration, please visit myaccount.aem-test.com and create a login, and register your product(s), please have proof of purchase available for upload during the registration process.
  5. Extended Care: TestPro and Network Service Assistant products with part numbers ending in “-ECB” include 1 year of Extended Care coverage. Extended Care runs concurrent with the standard warranty, to cover equipment damage outside the standard warranty, such as excessive drop damage, shattered display, water damage, etc.  Extended Care also provides free adapter replacement if damaged once during the 1-year coverage period.  For TestPro models, Extended Care also includes the annual calibration service within the coverage period. Extended Care may be renewed when coverage is nearing expiration and is available in 1-year and 3-year variants, please email sales@aem-test.com for renewal information.
  6. Release of Liability; Indemnification. Except where otherwise prohibited by law, by purchasing, you release and agree to indemnify and hold harmless AEM, its distributors, resellers and manufacturer sales representatives from any liability, injury, claim, suit, action, cost, expense, loss or damage of any kind, including any tax liability or loss of opportunity, whether direct, indirect, special or consequential, that may be imposed on, asserted against or incurred, that arise out of or relate in any way to the products purchased, including, but not limited to, where arising out of or relating to the following: (a) any technical difficulties or equipment malfunction (whether or not under AEM’s control); (b) any delivery issue by carrier, theft; (c) any damages due to the operation of a postal or courier service; (d) any tax liability incurred by purchaser.
  7. Buyers are bound by these Terms & Conditions and by the decisions of AEM, which are final and binding in all respects. To the fullest extent permitted by applicable law, AEM reserves the right to change these Terms & Conditions at any time, in its sole discretion, and to cancel the sales transaction should computer viruses, unauthorized human intervention or other causes beyond AEM’s reasonable control affect the administration, security or conduct of the transaction, or AEM otherwise becomes (as determined in its sole discretion) incapable of conducting the transaction as planned, or for any other reason determined by AEM to be appropriate in its discretion.
